Anna Volynets spoke at the Delovoy Peterburg conference “Bankruptcy-2020”
On March 4, a legal practical conference "Bankruptcy 2020" was held at Yasnaya Polyana coworking by "Delovoy Peterburg", the leading business title of the Northwest Russia. Participants in the insolvency market — arbitration managers, leading lawyers and attorneys at law, representatives of major banks — gathered to discuss the latest trends in practice development and changes in legislation. Anna Volynets, project manager of "Prime Advice", spoke on the topic "Inclusion in the register of claims of affiliates".
At the end of January 2020, the long-awaited Review from the Supreme Court on the practice of including claims of affiliated creditors in the debtor's register was adopted. The Supreme Court accepted the model of soft subordination, so affiliated creditors have a chance to get into the 3rd stage of the register on a par with independent creditors. However, given the specific criteria set out in the Review, it will not be easy to get into the third stage. During the discussion, E.L. Mazurik the judge of the arbitration court answered the conference participants’ questions and assessed the benefits of the Review, which has already been used actively by judges in bankruptcy cases.
